Choose the situation closest to yours to see how the intestacy rules in England and Wales would share things out today.
Step 1 · Choose your situation
Without a will
Your partner inherits nothing.
However long you’ve been together, an unmarried partner has no automatic right to inherit. Everything passes to your children, or if you have none, to your parents, then brothers and sisters.
Who inherits
With a will: your partner is provided for, and doesn’t have to go to court to make a claim.

Before you write it
The most common mistakes we see in wills, and how to avoid them.
Children can’t inherit directly until 18, and may then receive a large sum all at once. A simple trust lets you choose a later age and appoint someone you trust to manage it.
If your only executor passes before you or doesn’t want the role, it can cause delays. Always name a backup.
If you leave a particular car, house or account and it’s gone by the time of your passing, that gift simply fails. Wording it carefully avoids disputes.
In England and Wales, getting married or entering a civil partnership automatically revokes an existing will, unless it was written with the marriage in mind.
If a witness, or their spouse, is a beneficiary, they lose their gift. Witnesses should be independent adults.
Many pensions and policies pass by nomination forms, not your will. Check these are up to date alongside it.
